Intellectual Property Rights Protection — Claims, DMCA, Monitoring | IP EYE

Protecting Rights Against Violators

Has a competitor stolen your brand’s name or logo? Has someone “leaked” your online course to a public group or is reselling it for pennies? Or have you suddenly spotted a product on the shelf with packaging that’s indistinguishable from yours? For us at IP EYE, these situations are nothing new. We’ve handled hundreds of such cases: from fighting “clone” websites to large-scale patent wars over unique industrial designs. For example, in Ukraine—as in most countries around the world—trademarks are governed by the strict “first-to-file” principle. This means that trademark rights belong not to the person who came up with the idea first, but to the person who was the first to file an application for registration. Your idea without official registration is an opportunity for those engaged in so-called “patent trolling.”

Why Is This Important?

An effective approach to combating intellectual property infringers is based primarily on the following methods:

  • Preventive methods, i.e. registration and monitoring of violations. After receiving a certificate or other law enforcement document, we can recommend you a service of periodic monitoring of the information space for infringing content. This service includes an analysis of marketplaces, social networks and domain name registries to identify objects that have signs of similarity to the degree of confusion with the client’s assets. A violation detected in a timely manner allows you to apply to UKRNOIVI or the relevant competent authority with a statement “on objection to the registration of an intellectual property object”.
  • Claims work. Thanks to the submission of a competently drafted claim for infringement of trademark rights, in 90% of cases the situation finds a positive solution without involving the courts. For most infringers, the prospect of litigation is extremely unprofitable. The costs of qualified lawyers, court fees, expert examinations and the risk of losing the case with subsequent compensation for your losses make the continuation of the infringement economically inexpedient.
  • DMCA take-down. Effective protection of copyrights from violations in the digital environment is the use of the DMCA take-down notice procedure (in Ukraine and abroad). Thanks to this procedure, we have repeatedly achieved complete removal of content in Ukraine and abroad (in particular from such marketplaces as Prom, Amazon, Instagram, Etsy, etc.).
  • Removal of infringing content. We provide protection through interaction with web hosting providers, including removing links to infringing content from search results (Google, Bing, etc.), blocking infringers’ accounts on social networks (Facebook, Instagram, TikTok).
  • Judicial protection and appeal to state authorities. If pre-trial settlement methods have not yielded the expected result, we can proceed to filing a lawsuit in court and/or appeal to the Antimonopoly Committee of Ukraine.
  • Customs Registry. In order to prevent the import of counterfeit goods at the border crossing stage, we will ensure professional registration of your intellectual property objects in the Customs Registry of Ukraine and other countries (if necessary). This will allow customs authorities to effectively detect and block counterfeit goods before they enter the domestic market.

IP EYE Protection is a service built on extensive practical experience, which allows us to provide an honest assessment of future results. We know how social media moderators work, how to communicate with website administrators, and how to get law enforcement agencies to take action.

How We Work — Step by Step

Every situation is unique, so first, we need to examine your specific situation and develop the best defense strategy for your business; Preparing documents, gathering evidence, and filing requests to have infringing content removed, depending on the strategy we choose; Securing the outcome: We formalize the cessation of the infringement so that the opposing party has no opportunity to “resume” its activities tomorrow or at any time in the future. Every intellectual property case requires a tailored approach. We have moved away from “cookie-cutter” methods in favor of strategic planning, which ensures maximum results at minimal cost.

Who will lead the project?

FAQ

What should I do if a competitor has already registered my brand before I did?

In Ukraine and most countries, the “first-to-file” principle applies—rights belong to the first person to file an application. But this isn’t a foregone conclusion: we analyze the situation and look for grounds to oppose the registration through UKRNOIVI or another competent authority. The sooner you contact us, the more options you’ll have to protect your rights.

Is it necessary to go to court to stop the offender?

No. In 90% of cases, a well-drafted claim resolves the issue without going to court—for most violators, the prospect of legal costs and damages is a significant deterrent. We resort to legal action only when pre-litigation methods have failed.

How quickly can my content or brand be removed from a marketplace or social media platform?

Timelines depend on the platform and the complexity of the situation. Thanks to the DMCA takedown procedure and direct communication with platform administrators (Amazon, Instagram, Prom, Etsy, etc.), we have been able to get content removed quickly. During the initial consultation, we immediately provide an honest assessment of your specific situation.

How can you protect yourself from repeat violations after a case has been resolved?

We don’t stop at removing infringing content. Once a case is closed, we document the outcome in a way that minimizes the risk of recurrence, and we can also set up regular monitoring of marketplaces, social media platforms, and domain name registries to detect new infringements early on.
